Regional Labiur Commissioner (Central), New Delhi letter.

In response to the notice served jointly by the Airports Authority of India Mazdoor Sangh and Airport Aviation Employees Union for holding Relay Dharna and Lunch hour demonstration at Rajiv Gandhi Bhawan, Regional Labour Commissioner (Central), New Delhi has called a meeting on 13/04/2016 to discuss the demands for am amicable settlement.

भारतीय विमानपत्तन प्राधिकरण में प्रबंधन और मान्यता प्राप्त युनियन के मिलिभगत के कारण कर्मचारी वर्ग अपने मुलभूत अधिकारों से बंचित है। स्थानांतरण के नाम पर अन्य संगठन के पदाधिकारी व सदस्यों को प्रताडित किया जाता है। कर्मचारी पर गलत निति का उपयोग करते हुए पदोनिति (promotion) सही ग्रेड में न देकर निचले ग्रेड में किया जाता है। जो भी कर्मचारी उसका बिरोध करता है तो उसका या तो overtime बंद कर दिया जाता है या स्थानांतरण कर दिया जाता है।

Performance Related Pay vs Productivity/Performance Linked Rewards.

Whether PRP Scheme is applicable and beneficial to the workmen?
The Airports Authority of India Mazdoor Sangh after indepth study of PRP Scheme and having detailed discussion with the Central Leaders of Bharatiya Mazdoor Sangh oppose PRP Scheme on following grounds and urged the management of the Authority to introduce Performance/Productivity Linked Rewards wef 01/01/2007. 
i) Payment of PRP is admissIn 1997 the scheme of Productivity Linked Scheme (PLI) was introduced in Airports Authority of India. The scheme was introduced in lieu of Bonus payable to the workmen under Payment of Bonus Act, 1965. The PLI Scheme continued in Airports Authority of India but all in sudden it was replaced with Performance Related Pay (PRP) advance in 2010 at the blessing of recognised Union ie. Airports Authority Employees Union. The issue of PLI is pending before Central Government Industrial Tribunal, Delhi. The management continued to pay PRP advance till FY 2013-14. However in FY 2014-15 no such payment was made to the workmen of AAI despite huge profits earned by the Authority and making dividend payment of 392 crore to the Government of India.

iii) Not more than 20% of the total workmen shall be paid maximum PRP.
iv) The Payment of PRP creates discrimination within the workmen which ultimate affects the progress of industry.

Basic difference between PRP and PLR?
Although both schemes are based on the concept of profit sharing among the employees, the basic difference between the two scheme is that "while the payment of PLR shall be calculated based on the profits earned by the industry and performance of individual workman shall not be taken into consideration, whereas PRP shall be calculated taking into consideration of the profits earned by the industry and individual workman". It means despite profits earned by the industry, if the performance of any individual workman is poor, he/she will not be paid PRP.
What made change in the thought of recognised Union to oppose PRP?
It is the endeavour of AAI Mazdoor Sangh to make the workmen educated towards their rights. We share our concern among the employees through various mode. While we believe a well educated, knowledgeable workman is the assests of the organisation, we continue our efforts. Our continuous efforts and sharing information compel recognised Union to change their stand on payment of PRP after getting PRP advance. Our recent notice for holding three days Relay Dharna and Lunch hour demonstration at Rajiv Gandhi Bhawan compel recognised union and manage to became active on the long pending issue of profit sharing and Superannuation pension Scheme.
The Airports Authority of India has already formulated a scheme on profit sharing in consultation with MoCA which shall be placed before the Board for approval. Superannuation Pension Scheme will take some time. The management has violated the MoS (Memorandum of Settlement). The Regional Labour Commissioner (Central), New Delhi has called a meeting on the demands and Airports Authority of India Mazdoor Sangh shall demands for prosecution of the AAI officials for violation of the MoS.

Trade unionism in Airports Authority of India

Our constitution granted fundamental rights to form Union and Association. It is the freedom available to every citizen of this country. There is no bar for any citizen or workers of an industry to remain members of any particular Union. But inspite of legislative arrangement and constitutional provisions, the workmen of the Airports Authority of India forced to continue the members of the recognised Union. The monthly Union subscription of recognised Union are deducted from workers salary without adhering to the provisions of the Payment of Wages Act, 1936. Payment of Wages Act provides for deduction of monthly subscription of Registered Trade Union on written authorisation by the workmen. It means the right to contribute monthly subscription of Union of his/her choice is available to the workmen. In case any workman wishes not to contribute monthly subscription to the Union to whom he was a member, he can simply give in writing to his/her employer to stop his/her monthly contribution. He has the freedom to choose Union of his/her choice and contribute monthly subscription. But unfortunately this provisions are not being followed in Airports Authority of India. The AAI management vehemently violating the provisions of the act.
Inspite of adoption of the practice to recognised multiple trade union in industry, the Airports Authority of India still maintaining the old concept of One Industry, One Union. Even the Code of Discipline provides for recognition of multiple trade union. Most of the leading PSUs have accepted the concept of recognising multiple trade union. The Rules framed by the BSNL management is the fittest example. This concept creates a healthy climate in industry. This also favours the employees concern.
In most of the industrial establishment recognition of unions are granted for a period of 2 years. This help the workmen to change the Union after 2 years incase it failed to upkeeps the aspiration of workers. Contrary to above in Airports Authority of India recognition are granted for a period of 5 years in complete violation of the instructions issued by the Government of India, Ministry of Labour and Employment and workmen of the Authority are forced to suffer for the failure of recognised Union to fulfill the aspiration of workers.

Dear friends, the MoCA vide above quoted letter accorded approval of wage revision of non-executives. While granting the approval, additional increment after completion of 15 years of service was denied by MoCA. It is also a matter of record that Superannuation pension scheme was the part of wage revision and was approved by the MoCA on 20/1/2011. Despite approval, the recognised Union miserably failed to implement it even after passing of 5 years. It shows their concern towards employees welfare. When AAI Mazdoor Sangh and Airport Aviation Employees Union jointly holds Dharna and lunch hour demonstration on payment of PLR and implementation of Superannuation pension scheme, which was a great success with your support and compel the MoCA and AAI Board level officials to hold late night meeting on 29/03/2016 to arrived at a solution. The recognised Union is trying to delayed the payment of profit sharing among the employees, on some pretext or others. Friends, we are closely monitoring the development. Labour department has called a conciliation meeting on the two issues raised by us. We are optimistic both issues will be settled amicable and we shall not be deprived from our rightful demands.
